Applicable to all DigiChanges products and services

By accessing or using any DigiChanges platform or service, you fully accept these Terms and Conditions. If you do not agree with any of the provisions, you must not use our services.

Service Provider

DigiChanges is a software development company incorporated in the Republic of Argentina, dedicated to the design, development, and commercialization of SaaS (Software as a Service) products.

Description of Service

DigiChanges offers software as a service (SaaS) platforms that include:

  • Customer relationship management (CRM) tools.
  • Integration with third-party messaging platforms, including WhatsApp Business API (Meta).
  • Communication automation and contact management.
  • Analytics dashboards and reporting.

Specific features vary depending on the contracted product and chosen subscription plan.

Registration and User Account

To access our services you must create an account. By registering you agree to:

  • Provide truthful, complete, and up-to-date information.
  • Maintain the confidentiality of your access credentials.
  • Notify us immediately of any unauthorized use of your account.
  • Not assign or transfer your account to third parties without DigiChanges's express authorization.

You are responsible for all actions taken from your account.

Acceptable Use

You agree to use our services only for lawful purposes. The following are expressly prohibited:

  • Sending unsolicited communications (spam) or misleading content.
  • Using the platform for illegal or fraudulent activities.
  • Attempting unauthorized access to systems, data, or other users' accounts.
  • Reproducing, distributing, or modifying the software without express authorization.
  • Reverse engineering or decompiling any component of our platforms.
  • Sending messages in violation of Meta/WhatsApp Business usage policies.
  • Distributing illegal, discriminatory, violent content or content that violates third-party rights.

Third-Party Integrations

Our platforms allow integration with third-party services, including WhatsApp Business API (Meta). When using them:

  • You also accept the terms and conditions of the corresponding third-party service.
  • DigiChanges acts as a technological intermediary and is not responsible for the policies, availability, or changes in third-party services.
  • You are responsible for obtaining the necessary authorizations to use such services and for complying with their usage policies.
  • DigiChanges does not guarantee the continuous availability of integrations, which may be affected by decisions of external providers.

Plans and Payments

Access to our services may be subject to a subscription fee. When contracting a plan:

  • Prices are communicated at the time of contracting and include applicable taxes under Argentine law.
  • Payments are processed through secure payment platforms.
  • Plans automatically renew upon expiration of the contracted period, unless previously cancelled.
  • We do not issue refunds for partial periods, except as provided under Consumer Protection Law 24,240.

Intellectual Property

All software, design, trademarks, logos, documentation, and content of DigiChanges platforms are the exclusive property of DigiChanges or its licensors, protected by Argentine intellectual property laws and international treaties.

The use of our services does not grant you any ownership rights over these elements.

User Data and Content

You are the sole owner of the data you upload to our platforms. By using our services you grant us a limited license to process that data exclusively for the purpose of providing the contracted service.

DigiChanges does not sell or transfer your customers' data to third parties. For more information see our Privacy Policy.

Service Availability

We strive to keep our platforms continuously available. However, we do not guarantee 100% availability as interruptions may occur due to scheduled maintenance, infrastructure or provider failures, or force majeure events.

Limitation of Liability

To the maximum extent permitted by Argentine law, DigiChanges shall not be liable for:

  • Indirect, incidental, or consequential damages arising from the use or inability to use the services.
  • Data loss caused by user or third-party actions.
  • Interruptions caused by third-party providers (Meta, cloud services, etc.).
  • The content of messages sent by users through the platform.

DigiChanges's total liability shall in no case exceed the amount paid by the user in the last 3 months of service.

Suspension and Cancellation

DigiChanges reserves the right to suspend or cancel your access in the event of:

  • Breach of these Terms or the policies of integrated third parties.
  • Non-payment of the subscription.
  • Fraudulent use or suspicious activity.
  • Requirement by competent authorities.

You may cancel your subscription at any time from your account settings. Cancellation will take effect at the end of the current billing period.

Modifications

DigiChanges may modify these Terms and service features at any time. We will notify you of significant changes at least 30 days in advance. Continued use of the service implies acceptance of the new terms.

Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Argentina. For any dispute, the parties submit to the jurisdiction of the Ordinary Courts of the Autonomous City of Buenos Aires, expressly waiving any other jurisdiction.

If you are considered a consumer under Consumer Protection Law 24,240, you shall enjoy all the rights granted by that regulation.
